MSME-1
Half-yearly return of delayed MSME payments. Report payments to micro and small suppliers that were outstanding beyond 45 days.
| Who files | Specified companies that received goods or services from micro or small enterprises and crossed the delay. |
|---|---|
| Governing law | Section 405 read with the Specified Companies order |
| Due | For April–September, by 31 October. For October–March, by 30 April. |
| How it is filed | MCA V3. |
| Fee | Normal fee. |
| Certification | Director signatory as the form requires. |
The law
The order made under section 405 on 22 January 2019. It covers micro and small suppliers. A medium enterprise is not a row on this form. The delay is more than 45 days.
The deadline
April to September, by 31 October. October to March, by 30 April.
If it is missed
Disobeying an order under section 405 has its own consequence in that section. Paying the supplier later does not erase a half year in which the amount was already overdue.
The remedy
File the half year that had a delay. If nothing was outstanding beyond 45 days, there is nothing to report. Do not file a story of delays that did not happen.
When to file
- There is a payment to a micro or small enterprise outstanding for more than 45 days.
Attachments
- Ageing of MSME creditors
- Supplier MSME registration particulars
Steps
- Confirm the supplier is micro or small, not merely medium.
- Compute days past the agreed date, or 45 days if there is no agreement.
- File only the delayed items.
Questions
- Is a medium enterprise covered?
- The return is aimed at micro and small enterprises. A medium classification does not by itself create an MSME-1 row.
