Applicability starts here. A public company is not a small company. An LLP is not in section 135. A section 8 company can still owe CSR.
Private company
At least two directors and two members. Share transfer is restricted.
Public company
At least three directors and seven members.
One Person Company
One member and at least one director. A nominee is named.
Limited liability partnership
Not a company. Sections 92, 135 and 137 do not apply.
Section 8 company
Formed for a charitable object. Profits are applied to the object.
Foreign company
A body incorporated outside India with a place of business in India.
